1. Acceptance of Terms

By downloading, installing, or using DropNote ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

DropNote is a location-based note-sharing application that allows users to:

• Create and "drop" digital notes at physical locations
• View notes left by others in their vicinity
• Share notes privately with specific users
• Create business promotional content (for business accounts)

3. Account Registration

To use DropNote, you must:

• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account use

You are responsible for all activities that occur under your account.

4. User Content

4.1 Your Content

You retain ownership of content you create ("User Content"). By posting content, you grant DropNote a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the App.

4.2 Content Guidelines

You agree NOT to post content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Contains hate speech or discriminates based on race, religion, gender, or other protected characteristics
• Is sexually explicit or pornographic
• Infringes on intellectual property rights of others
• Contains personal information of others without consent
• Is spam, advertising, or commercial solicitation (except for approved business accounts)
• Contains malware, viruses, or harmful code
• Impersonates another person or entity

4.3 Content Moderation

We reserve the right to:

• Remove any content that violates these Terms
• Suspend or terminate accounts that repeatedly violate guidelines
• Report illegal content to appropriate authorities

5. Business Accounts

Business account holders may create promotional content subject to:

• Accurate representation of their business
• Compliance with all applicable advertising laws
• No misleading or deceptive offers
• Respect for user privacy and consent

6. Location Services

DropNote requires location access to function. By using the App, you consent to:

• Collection of your location data as described in our Privacy Policy
• Display of your general location to other users when viewing shared notes
• Background location access for proximity notifications (if enabled)

7. Intellectual Property

The App, including its design, features, and content (excluding User Content), is owned by DropNote and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Use our trademarks without permission

8. Prohibited Activities

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Create multiple accounts for abusive purposes
• Use automated systems or bots to access the App
• Harass, stalk, or harm other users

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, DropNote shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless DropNote, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account and User Content
• Provisions that should survive termination will remain in effect

13. Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms. We will notify users of significant changes.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
